I would say breaking the splines will obviously create new spline ends, and hence new constraints.  Automatic constraints are a "best attempt" at figuring out what would be useful to include, but the constraints present should always be checked and adjusted as needed, and not just rely on the program's intelligence.  There are many factors that I'm sure go into that intelligence decision rubric, and it's not surprising that get different results at different locations, despite being symmetric geometry.

well the old should not at least be removed

I will log a bug and fix it - just simply remove the old constraint. The smooth constraint should be only available among connected curve and a spline
