Not sure what your error is in Eagle Point, but I get no errors in C3D13 nor are there any errors found with an audit.

What version of Autocad or CIvil 3d are you trying to run with Eagle Point 2009?

It never worked for me beyond the 2010 dwg file format, which was used in Autocad releases 2010 - 2012.

Eagle point Civil will not work beyond Civil 3D 2012 and Eagle Point stopped supporting that software in conjunction with Autocad 2013 release.  Look into the Surveyors Companion and Data Reduction modules if you wish to continue to use Eagle Point in your workflow.
