Imported Layerstates not working in sheet drawing

Hi.  Really beating my head against the wall here...  any help would be great.  This is my first post, so be nice.  

 

Let's say Im working on what we call project 1. 

I set up layerstates in xref1.  I then start a drawing called sheet1.  When I use apply nested xref layerstates in my sheet1, all works correctly. and I export those layerstates from xref1 into a file i'll use later.  

 

Then I begin project 2. 

I open a new drawing.  I  copy the linework in from xref1, and import the layerstates that I exported previously.  The imported layerstates work fine.  I save that drawing as xref2.    I then create a new sheet2.  This is where things start to misbehave...

 

When in sheet2,  I apply the embedded xref layerstate from xref2.  Nothing happens.  

 

Now strangely enough,  If in xref 2,  I apply floor plan layerstate,  and then create a new layerstate,  it works in sheet2.

If you look at the project1 sheet1 dwgs Layer properties palette and compare that with project2 sheet2 dwgs are the xref layer names the same or different?

Perhaps try the same process but in a test dwg with only say 5 layers and see how that goes
