Railing - can't remove Top rail.

Hi I can't remove the 'Top rail'. 

When I uncheck the 'Top Rail' box I get the following error. Please see attached.

All Balustrades appear won't appear unless the  'Top Rail Element' is selected?

You do not remove it... Instead you delete it

• place the railing and finish sketch >>
• tab select the top Rail >>
• Unpin >>
• Delete
