We use xrefs extensively and do use the overlay feature. However if you ever merge an xref, the overlay setting is ignored and nested xrefs become xrefs of the scene you are merging the xref into. This often leads to duplicate xref definitions. Ignored classes (lights, cameras etc) are respected, so adding xrefs to the list would be great.
As well as the above, perhaps max should check the xref list and prompt the user if a nested xref already exists in the current scene. I am sure someone out there will have a use case for referencing the same max file twice, but I would think this would be rare and bad practice.
