Yes, OVERKILL, and specifically, in its dialog box after selecting items, un-check the Layer property, meaning "do not ignore the Layer, but take it into consideration, in determining whether objects duplicate each other."

That way, the ones on different Layers will not be considered as coinciding, and only a duplicate on the same Layer as a coinciding object will be removed.
