viewId is not a view. -or- viewId is not valid for element iteration exception

Hi how do you avoid this error, when getting text notes and lines from legends? 

This si related to my last post, is big problem revit api docs has mention of this exception

viewId is not a view. -or- viewId is not valid for element iteration, because it has no way of representing drawn elements. Many view templates will fail this check
