Re: Protection against intellectual property theft

05-08-2012 12:24 PM in reply to: cadhawk

As a company we understand that our customer’s data is important and we respect intellectual property (IP).  We want to make sure you know that when you use Autodesk PLM 360 or other cloud services from Autodesk, you own and control your own IP.  The words in each of our terms of service govern your use of the services but we wanted to share some background with you about why we need the rights granted by you in these agreements. The specific terms are available here: ww.autodesk.com/termsofservice

The use of Autodesk’s cloud services involves your digital content and information which means Autodesk needs you to give us certain rights in order to provide these services.  For example, the systems providing the services in the cloud need to do things like “display” “modify” “reproduce” and “transmit” your content and data as part of providing the services.  Without the ability for us to do these things with your information and content, these cloud services could not function.  The agreements also limit our rights.  For example, our rights in our Autodesk Cloud terms are limited to the context of providing, maintaining, repairing, protecting, organizing or otherwise administering the services and improving and modifying the services.  The license is limited to this and its purpose is to make sure we can offer you these services.

Unfortunately, the way the TOS reads does not match AutoDesk's comment earlier in this thread. Please rework the TOS to indicate that you will not sell, distribute or use our work in any method that is not explicitly authorized by the user.

I understand you need certain permissions to operate the service, but under the TOS, you could potentially sell our work to our competitors and we would have no recourse. This is not acceptable.

Chris,

we'll be making some revisions very shortly.  They'll be posted on the web for everyone.  They're worded much more clearly to state things like your ownership, etc.

Stay tuned.

This came up in the office today. But it looks like point 2.1 fully addresses this now? http://usa.autodesk.com/adsk/servlet/item?siteID=123112&id=21310328

Scott,

This is kind of a two fold set of questions in here.

1. Do you own your content.  For sure the 2.1 section covers that - we reworded that section (and others) to be much more clear

2. Is there encryption.

The answer to the second one is yes - and two fold

a) We encrypt over the wire - this is "HTTPS" like you would expect with any web site.  You can easily see this via the browser

b) We also encryp "At Rest".  This means when any data is stored on our drives that data is encrypted as well.  This means... in the "literal" case that was stated at the beginning - IF someone could physically access the data; that would be encrypted.

HTH
