Disclaimer when emailing electronic files

I wonder what others are doing for a legal disclaimer when emailing
cad files to consultants and/or contractors.

Anyone willing to share what they append with an email transmittal?

ANY CAD file that we send out - whether email or CD gets this notice. Names
have been changed to protect the innocent :smileywink:

To whom it may concern:



At your request we are furnishing you with AutoCAD drawings.
Because the CAD information stored in electronic form can be modified by
other parties intentionally or otherwise, without notice or indication of
said modifications, YOUR COMPANY reserves the right to remove all indices of
its ownership and/or involvement in material from each electronic medium not
held in its possession. This material shall not be used by you or
transferred to any other party for use in any other projects, additions to
the current project or for any other purpose for which the material was not
strictly intended by YOUR COMPANY without our express written permission.
Any unauthorized modification or reuse of the material shall be at your sole
risk, and you agree to defend, indemnify, and hold YOUR COMPANY harmless for
all claims, injuries, damages, losses, expenses and attorneys fees arising
out of the unauthorized modification or use of these materials.



The recipient understands that the use of any project related
computer data constitutes acceptance of the above conditions. On this
basis, YOUR COMPANY is pleased to be able to provide CAD files related to
the project.

Ours looks something like this

The accompanying files are supplied as a matter of courtesy and are in no way to be taken as appurtenant to, associated with or as a replacement of copies of the officially sealed documents. The data is provided "as is" without warranty of any kind either expressed or implied. Any person(s) or organization(s) making use of or relying upon this data,
is responsible for confirming its accuracy and completeness. These files do not include a professional surveyor's/engineer's stamp and only drawings with such stamp are to be considered as true and final. the terms and conditions, please contact our office prior to use of the
referenced information.

Please be advised that the attached files are in a format that can be
altered by the user. Due to this fact, any reuse of the data will be at
the user's sole risk without liability or legal exposure to U.S. Truss
Inc., and user shall indemnify and hold harmless XXXXXXXX Inc. from all
claims, damages, losses and expenses including attorney's fees arising
out of or resulting from using the digital file.

In addition, it is the responsibility of the user to compare all data
with the hard copy drawing(s). In the event there is a conflict between
the hard copy drawing(s) and the electronic file, the hard copy
drawing(s) shall prevail.

we get a signed release before CAD files are sent.

but nothing is attached to the email (pretty much a wasted effort IMO).

It varies, but is a result of the clients lawyers talking to the client executives talking to our executives talking to our lawyers.

Here is the cad file you requested.
In .dwg format. If you can not open it
then buy the correct software, if you are to anal
then we are not sorry for you.
Remember we have the original and can prove you
may or may not have changed something.
If cad support is not sent back or provided for our
use then our 300 lb gorilla will be sent.
