check in/out in 2009

Has anyone else notice that you can check out a non editable layer from SDE 9.2. You will not be able to save it back to SDE because of permissions set for the login. But you should not be able to even check it out in the first place if login does not have permission to edit that layer. Is there a setting that I am missing? I don't want to set the layer selectable every time, and once others find that button, big problems are on the way. any thoughts?

If you edit an SDE layer and don't have permission to save then back you can
save that SDE layer w/the edits to SDF format.
The autocheck out of a feature can be turrned off however it is for all
layers, there's no way to turn it off for certain layers or connections.
