Yes, there are places where Civil 3D does not allow 0 thicknesses. Maybe someday...
There are a fair number of places where you cannot use a 0 width either, even though it would be appropriate for some designs.

I still need to see your settings to be clear.
So are you saying if you have a top layer of some thickness greater than zero, with all other layers zero, it doesn't work?
That subassembly appears to still have problems in 2014 also...
Here's how it looks in Layout and Section View for the settings I show below where I am just trying to create a 4" Pave 1 depth. It still creates the other Materials:
