Max Design 2010 / 2011, 12/24HT core machine, Mental Ray fails on startup

This one certainly qualifies for "This weeks Der Untergang clip idea"

I have tried installing both design 2010 and design 2011 on windows server 2008 R2 Standard on a dual Xeon x5650 machine. e.g. 2 procs, six cores each for a total of 24 virtual cores with hyper threading enabled.

Max refuses to start either as editor, called by backburner or by distributed bucket rendering.

According to this thread

http://superuser.com/questions/124269/3d-studio-max-and-2cpus-core-limit

there is a limit on the amount of cores mental ray can (or will?) handle and removing the mental ray plugin does allow max to start.

Is this a known software or license limit in mental ray?

Are the any plans to increase the limit?
