you can try to run it compatibility mode: http://windows.microsoft.com/en-us/windows/make-older-programs-run#1TC=windows-7

not guranteed to work

2010 is not supported in Windows 8 or 8.1. The environment is simply too new and was not available for the testing or programming phase of the 2010 product. Your best option is to install on a supported platform or upgrade to the latest version of Max.
