No, the time for that ended last March.  You will have to pay full
price for 2009.  You might still find a 2008 version on the shelves
somewhere, but keep in mind you lose a year in your ability to upgrade
later.

Most likely you will NOT be able to authorize it, so it will run for 30-days
and die.

You missed your upgrade window last march.

Getting the discount might have expired but plenty of people do installs
and reinstalls after upgrade dates. Getting an authorization code isn't
limited that way. Look at how many people buy upgrades but then never
use them if they hear bad things about the upgrades.

Buying from a legal source with a legit copy 6-months AFTER Autodesk pulled
all copies from the market is were it gets interesting.

I agree that buying it is the real issue, but if you hunt, and not on
EBay, you may find an Office supplies dealer or such that might have old
inventory to clear out (assuming that Autodesk doesn't allow them to
return old packages in exchange for new packages) is a real possibility.
Also, in today's economy it is possible that somebody out there bought a
copy and never used it when business didn't develop as they had hoped.
As long as it is still in the original sealed package and the seller is
honorable with a money back guarantee if there is a problem authorizing,
it is still possible.
