how to separate my solid with nurbs? aca 12

hello,

i have an issue that i want to separate my yellow solid with nurbs surface (light green). the yellow solid is my walkway which has to follow the terrain (nurbs). please advice. or is there an easier way to split these two?

I use the intersect command to create the driveway from the terrain. Select the road for the intersect object.  Do not erase.  Then, select terrain/boolean/subtract and subtract the road from the terrain.   I also do curbing the same way.   I love the drape command, but it's been a really unstable process for me.  I constantly abort when I start working with the terrain.
