Xref scene BUG

Does anyone else have this bug:
Add a .max file as Xref scene and uncheck the option "Visible" - now it becomes invisible in the viewport. But... When you close Max and reopen the scene the xref scene is VISIBLE again despite that the option is unchecked! I'm running Max 2012 x64 under Win7 x64. Both service packs and hotfixes are applied.

EDIT: Just noticed that "Display as box" option does not work too.

Xref scenes also becomes visible again when they are simply updated and reloaded.. To make in invisible again I have to check+uncheck in xref scene -> display options -> visible.

I installed all hotfixes to Max 2012 and the problem persists.

Its a Nitrous problem AFAIK
It should work in Direct3d mode...
